If you register for a ThinkLA event, conference or product online/offline, or e-mail or otherwise contact us with a request or comment, we may use any information provided (including your e-mail, postal, or telephone information) to update
already existing databases.
Registration for events or other information provided may be retained in our databases and used as described below.
- Information provided will be added to our contact database to be used for current events announcements, membership drives or general ThinkLA news and updates. You may request that your information not be retained or utilized by ThinkLA however please
note if you choose to "opt out" of our database you will not receive any correspondence about ThinkLA via email or mail, including confirmation email for events.
- Registration information also becomes part of an "attendee list" which may be provided to our sponsors for various events. General "attendee lists" provided to sponsors include the attendee's Name and Company. For various events the attendee's Email
Address will also be provided. You may request that your information not be retained or utilized by ThinkLA by notifying us at info@ThinkLA.org.
ThinkLA compiles lists from our database for communications and marketing purposes. Under no circumstances will ThinkLA furnish or distribute personally identifying information to outside organizations, entities or companies without a user's consent.
ThinkLA's active member contact information will be published in the "ThinkLA Online Membership Directory" available at www.ThinkLA.org.
Active members will have access to the "ThinkLA Online Membership Directory" by using a username and password which is either created by the member at the time of membership registration or provided by ThinkLA management office once a membership
application is processed. Members may choose to request that their information not be published on the "ThinkLA Online Membership Directory" by updating their membership profile preferences or by notifying us at info@ThinkLA.org.
An active member is defined as a member who has paid full membership (individual or corporate) dues and their application has been processed by the ThinkLA management office.
Credit card transactions are processed using SSL data encryption.
4. SUBMISSION OF PERSONAL INFORMATION
You are required to provide true, current, complete and accurate Personal Information and we have the right to refuse or revoke your right to use our Services and/or reject and delete any entry you make if we have reason to believe that the Personal Information
you provide to us is or may be false, fraudulent, or inconsistent with this Privacy Policy. If you are submitting Personal Information on behalf of others in your business for registration purposes or otherwise, you represent that you have their permission,
agreement and full authorization to provide this Personal Information to us for these purposes. We reserve the right to ask you to provide evidence of that at any time during, or even after, the submission process or to contact those individuals to
confirm this at any time. If we determine that such authorization has not been properly obtained, we may immediately and without notice, discontinue your use of those features of our Services.

ThinkLA is a non-profit corporation, founded to promote Los Angeles as a leading center of creativity and innovation in media, marketing and advertising. Through our Website we offer users access to sign up for our newsletter as well as networking, educational,
social and charitable events to promote the constituents of the marketing and media industry including entertainment and production companies, advertising and marketing agencies, and supplier industries serving the community. We also offer services
to new and existing Members (as defined below) of ThinkLA.
2. REGISTRATION / USER IDs AND PASSWORDS
Because some aspects of the Services are not generally available to the public, you will be required to create a unique user ID and password to gain access to such features. We may also, from time to time, provide you with additional codes or passwords
necessary to perform certain transactions or otherwise access the Services. Your user ID, password, and any additional codes or passwords used to access our Services are collectively referred to herein as "IDs". Your IDs are personal to you. You agree
that you will not allow another person to use your IDs to access and use the Services under any circumstances.
You are solely responsible for maintaining the strict confidentiality of your IDs and for any charges, damages, liabilities or losses incurred or suffered as a result of your failure to do so. We are not liable for any harm caused by or related
to the theft of your IDs, your disclosure of your IDs, or your authorization to allow another person to access and use the Services using your IDs. You agree to immediately notify us if you become aware of any unauthorized use of your IDs or other
need to deactivate any IDs due to security concerns. You hereby acknowledge and agree that you are solely responsible for all activities, acts and omissions, and transactions that occur in, from, through or under your Membership or IDs.
3. ThinkLA MEMBERSHIP
Users also have the opportunity to register as members ("Members") of ThinkLA. Membership to ThinkLA is open to individual professionals working in advertising, marketing, public relations, media, production services and advertising related fields, and
to companies who support ThinkLA's commitment to the advertising industry and want to offer their employees the opportunity to be involved in the community on a corporate basis (collectively, "Membership"). Please visit the "Membership" section of
our Website to review the features and benefits associated with each type of Membership. Corporate Members are able to register additional "key employees" who will each require unique IDs to access the Services (each, an "Authorized User"). All Members
acknowledge, understand and agree that we will rely on your list of Authorized Users (and any updates and notifications we receive from you in accordance with the terms of these Terms of Use) to enable your Authorized Users to access and use the Services.
For the avoidance of doubt, any reference to "your IDs" within these Terms of Use includes the IDs of your Authorized Users. It is your sole and exclusive responsibility to ensure that each Authorized User has the requisite authority, permissions
and entitlements ("Authority") necessary to access and use the Services. We have no obligation to validate any such Authority and you agree that we shall not be liable for any transactions executed or information or content provided via the Services
in violation of any such Authority. We reserve the right to approve or reject, at any time, at our sole discretion, the registration of any new Member, or the attempted renewal of any existing Membership.
All active Members will have access to a membership directory ("Membership Directory"), which lists all Member names and any other Member-identifying information that we deem appropriate to include in furtherance of making such Membership Directory
available via the Services.
Prior to the expiration of the then-current Membership period, an email will be sent to each Member alerting them of such expiration, at which time the Member will have the option to terminate their Membership or continue their Membership for
the upcoming renewal period by paying the applicable Membership fee.
4. ThinkLA EVENT & NEWSLETTER REGISTRATION
User may register to participate in various events and/or to receive our newsletter. If you register for any ThinkLA event, conference or product, or e-mail or otherwise contact us with a request or comment in connection with the Services, we may use
any information you provide (including your e-mail, postal, or telephone information) to update our existing databases. Registration for events or other information provided may be retained in our on-line and off-line databases and used as described
below.
Information provided will be added to our contact database to be used for current events announcements, Membership drives or general ThinkLA news and updates, as well as for communication and marketing purposes. You may request that your information
not be retained or utilized by ThinkLA by "opting-out". Please note if you choose to "opt- out" your information will not be included within our database and you will not receive any correspondence about ThinkLA via email or mail including confirmation
emails for events.
When you register for an event the information you provide also becomes part of an "attendee list" which is provided to our sponsors for various events. General attendee lists provided to sponsors include the attendees name and company. For
various events the attendees' email addresses will also be provided. You may request that such information not be retained or utilized by ThinkLA by notifying us at info@ThinkLA.org.
5. USER INFORMATION
Our ability to provide certain aspects of the Services to you is dependent upon our collection, aggregation and distribution of the information we receive from you, including, without limitation (i) your company's name, address, telephone number(s), email
addresses, and any other data that identifies your business, and any other information you disclose to us in connection with your use of the Services (collectively, the "User Information"). Therefore, you hereby grant ThinkLA a world-wide, perpetual,
royalty-free right and license to use, collect, display and distribute the User Information for purposes of providing the Services (unless you "opt-out" as otherwise set forth in these Terms of Use). Further, all Members hereby grant ThinkLA a world-wide,
royalty-free right and license to publish the Membership Directory.
You represent, warrant and covenant to us that you have full authority to disclose the User Information to ThinkLA, any and all User Information and any other information or data you provide to us in connection with your use of the Services,
is and will be, true, accurate and complete when given to us, that in providing such information to us you will not knowingly omit or misrepresent material facts or information, and that you will promptly submit corrected or updated information via
the Services, or otherwise advise us promptly in writing of any such changes or updates to any information you've provided to us. You further consent and authorize us to verify your User Information as required for use and access to the Services,
as applicable.
6. MODIFICATIONS
We have the right, any time and from time to time, for any reason in our discretion, to change these Terms of Use, including the Privacy Policy and any Additional Terms that apply to our Services. We will post notices of material changes on our Website

Terms of Use, we may deactivate, cancel, suspend or terminate your use, Membership (if applicable) and any other use of our Services, in whole or in part, without notice to you. We may declare all monies then due, owing and outstanding immediately
due and payable and we will have no liability or further obligation of any kind to you or any other person and you will not be entitled to any refund.

ThinkLA may recommend and/or endorse the use of third party products or services and/or include promotional information, URLs, or hypertext links to other parties' websites in connection therewith, or any other form of re-direction of your connection

11. LIMITATION OF LIABILITY AND RELEASE
YOU UNDERSTAND AND AGREE THAT, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, NEITHER WE NOR OUR EMPLOYEES, AGENTS, LICENSORS, REPRESENTATIVES, OPERATIONAL SERVICE PROVIDERS OR SUPPLIERS, SHALL, UNDER ANY CIRCUMSTANCES, BE LIABLE FOR ANY CLAIM, LOSS OR DAMAGE,
DIRECT OR INDIRECT, INCLUDING, BUT NOT LIMITED TO, ANY AND ALL COMPENSATORY, CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER AND IF APPLICABLE, YOUR REGISTRATION, MEMBERSHIP, ANY CONTENT, PRODUCTS
OR OTHER FEATURES, FUNCTIONS, TRANSACTIONS OR ACTIVITIES ASSOCIATED WITH OR ARISING FROM OR THROUGH OUR SERVICES, REGARDLESS OF THE FORM OF THE ACTION, THE LEGAL THEORY OR THE BASIS OF THE CLAIM AND WHETHER OR NOT ANY PARTY HAS BEEN ADVISED OF THE
POSSIBILITY OF DAMAGES. IF ANY LIMITATION ON REMEDIES, DAMAGES OR LIABILITY IS PROHIBITED OR RESTRICTED BY LAW, WE SHALL REMAIN ENTITLED TO THE MAXIMUM DISCLAIMERS AND LIMITATIONS ON REMEDIES, DAMAGES AND LIABILITY AVAILABLE AT LAW AND EQUITY IN SUCH
SITUATION, HOWEVER, IN NO EVENT SHALL OUR LIABILITY TO YOU FOR DAMAGES OR OTHERWISE EXCEED THE LESSER OF: (I) THE AMOUNTS PAID BY YOU FOR ACCESS TO OUR SERVICES DURING THE TWELVE (12) MONTHS PRECEDING ANY SUCH CLAIM FOR SUCH DAMAGES OR (II) $100.00.
In the event you have any dispute with one or more third parties as a result of your use of our Website, Content or the Services, or are in any way damaged as a result of any third party in connection therewith, you hereby release and covenant
not to sue or otherwise make a claim, demand or file any legal action or institute any legal or regulatory proceedings against us, our employees, agents, representatives, operational service providers and suppliers, for any claims, actions demands
or damages (whether direct, indirect, special, incidental or consequential), of whatever kind or nature, known or unknown, suspected or unsuspected, whether foreseeable or not, disclosed or undisclosed.
12. INDEMNIFICATION
You agree to defend and indemnify us, our employees, agents, licensors, representatives, operational service providers and suppliers against any and all demands, claims and actions and you will hold us harmless from and against all losses, damages, costs
and expenses (including reasonable attorneys' fees) resulting from your breach or violation (or any Member's Authorized User's breach or violation) of these Terms of Use, the public posting or display of any material, content or items you submit or
provide to us (including, without limitation, your User Information), or your alteration, use, export or disclosure of any Content, as well as your violation of law or regulation or your infringement, misappropriation or any violation of the rights
of any other party. We may, if necessary, participate in the defense of any such claim or action and any negotiations for its settlement or compromise. No settlement which may adversely affect our rights or obligations shall be made without our prior
written approval. We reserve the right, at our own expense and on notice to you, to assume exclusive defense and control of any such claim or action and then your corresponding indemnification obligation will end.
13. MISCELLANEOUS
If any term or condition is held illegal, invalid or unenforceable, this will not affect any other provision each of which will continue in effect. Any term or condition which must survive to allow us to enforce its meaning shall survive; however no action
arising out of these Terms of Use or your use of our Services, regardless of the form of action or basis of the claim, may be brought by you more than 1 year after the cause of action has arisen (or if multiple causes, the date the first cause arose).
Our delay or failure to take any action shall not be or be construed as a waiver of that or any other term, condition or right we may have. You may not transfer, assign, convey or delegate your Membership, IDs, or right to use our Services to anyone
else and any attempt by you to do so shall be null and void ab initio.
14. LAW THAT APPLIES
Your use of our Services and these Terms of Use, shall be governed, construed and enforced the laws of the State of California applicable to contracts made, executed and wholly performed in California. You unconditionally and irrevocably submit to the
exclusive jurisdiction and venue of the State and Federal Courts situated in the State of California and you shall not object to such jurisdiction or venue on the grounds of lack of personal jurisdiction, inconvenient forum or otherwise. These Terms
of Use shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, which is expressly excluded and you also expressly agree to exclude the applicability of the Uniform Computer Information Transactions
Act. A printed copy of these Terms of Use and of any notice in electronic form shall be admissible in any judicial or administrative proceedings to the same extent and under the same conditions as other business documents and records originally generated
and maintained in printed form.
IN ANY CLAIM, ACTION OR PROCEEDING TO ENFORCE ANY RIGHT OR OBLIGATION OF THE PARTIES UNDER THE AGREEMENT, INCLUDING, WITHOUT LIMITATION, RELATING TO YOUR USE OF OUR SERVICE, YOU HEREBY WAIVE ANY RIGHT YOU MAY NOW HAVE OR HEREAFTER POSSESS TO
A TRIAL BY JURY.
15. ENTIRE AGREEMENT
Our Privacy Policy, and any Additional Terms that may apply to you and your use of our Services, are incorporated into and form a part of these Terms of Use as if fully set forth herein,
and together represent the complete and exclusive statement of terms and conditions between you and us regarding your use of the Website and Services, superseding any and all prior or inconsistent agreements, understandings, discussions, communications,
written, oral or otherwise, relating thereto.
YOU ACKNOWLEDGE YOU HAVE READ AND UNDERSTAND THESE TERMS OF USE AND AGREE TO BE BOUND BY AND FULLY COMPLY WITH ALL THE TERMS AND CONDITIONS HEREIN.

ThinkLA Events Policy and Code of Conduct
This page contains waivers of your legal rights and an agreement by you not to sue ThinkLA for certain claims related to COVID-19. Please read this page carefully and do not check “I Agree” on the event registration page unless you agree to these terms.
If you check “I Agree,” the terms of this page and release become binding on you even if you have not read it.
1. Privacy Notice
Registered attendees consent to share their email addresses with ThinkLA, who will add this information to our database and may provide contact information to our sponsors. If you do not wish to receive any communications from ThinkLA or share your email
address, please contact us at events@thinkla.org.
2. Safe Space
This is a safe space. ThinkLA does not tolerate harassment of any kind. If you find yourself in a situation where you feel uncomfortable, or you see something that needs attention, please find a ThinkLA staff member and we will help you immediately. Together,
we can support each other and make our community and world a better place.
3. Virtual, Chat, and In-Person Event Code Of Conduct
Unacceptable behavior from any event attendee will not be tolerated either online or in person. Unacceptable behavior includes, but is not limited to:
- Failure to obey any rules or regulations of the event venue or of the chat moderator or event team;
- Intimidating, harassing, abusive, bullying, discriminatory, derogatory, or demeaning speech, materials, or conduct by any participants of the event and related event activities;
- Personal insults, particularly those related to gender, race, religion, sexual orientation, or (dis)ability;
- Sexist, racist, homophobic, transphobic, or otherwise discriminatory jokes and language;
- Violence, threats of violence, or violent language directed against another person;
- Any boisterous, lewd, or offensive behavior or language, including but not limited to using sexually explicit or offensive language, materials or conduct, or any language, behavior, or content that contains profanity, obscene gestures, or racial,
religious, or ethnic slurs.

5. Photography, Screenshots and Video Disclaimer
You understand that ThinkLA wishes to obtain the right to record and use your name, picture, photograph, likeness, voice, performance, and/or other personal identification provided by you to ThinkLA (collectively, the “Material”) on videotape, film, or
any other audio and/or visual medium for use in connection with the that event that you selected to register for a plan to attend and/or participate in. By completing the registration information on this site, you confirm that you hereby grant ThinkLA
the unrestricted right to record and use the Material, in whole or in part, in any manner and any media, including advertising, promotions, and any other commercial use. You acknowledge that you shall not be entitled to any compensation by ThinkLA
hereunder.
6. ThinkLA Registation Policies:
- Your registration is only valid for the event for which you’ve registered.
- Pre-event registrations may be transferred to other members of the same company if notice is provided to the ThinkLA within at least 48 hours of the event by emailing events@thinkla.com.
Registrations may
be canceled by emailing events@thinkla.com and are subject to our cancelation policy.
- CANCELLATION and RETURN CHECK POLICY
- To cancel an event registration and to receive a refund (less a 3% processing fee), contact our office in writing at events@thinkla.org no later than three business days prior to the
event date by 5:00 PM PDT. No refunds will be issued after this time period. A $15 return check fee will be assessed on any dishonored checks.
- ThinkLA reserves the right to cancel or modify a registration at its discretion
- Discount codes are not transferable, cannot be applied retroactively, and can be canceled by ThinkLA at its discretion. ThinkLA reserves the right to void a registration if the person using a code is not eligible for the promotion.
- Each attendee must have their own printed credentials. Credentials cannot be transferred, shared, or split.
ThinkLA has a no soliciting / no suitcasing policy. Anyone found violating this policy will be asked to leave immediately and their credentials
will be revoked without a refund.
COVID and Monkeypox Policy and Code of Conduct
1. Confirmation of Vaccination and Release of Liability
The individual registering (referred to as “You/your”) for the applicable in-person event (the “Event”) to be hosted by ThinkLA hereby agrees to the following terms (this “Release”) in consideration of being permitted by ThinkLA to attend the Event and
in recognition of ThinkLA’s reliance on your agreeing to this Release:
If you are planning to attend in person the event, you confirm the following:
- You are fully vaccinated and at least one additional vaccine booster for the 2019 novel Coronavirus disease (“COVID-19”);
- You are not experiencing symptoms of COVID-19 (such as cough, shortness of breath, loss of smell, or fever);
- You do not have a confirmed or suspected case of COVID-19;
- You have not come in contact in the last 14 days with a person who has been confirmed to have or suspected of having COVID-19, nor have you traveled internationally in the last 14 days;
- You will comply with all federal, state, and local laws, orders, directives, and guidelines related to the Event and COVID-19 while participating in the Event, including, without limitation, requirements related to hand sanitation, social distancing,
and use of masks and face coverings, based on the current Los Angeles County and State Guidelines;
- You will follow all policies, protocols, rules, instructions, recommendations, and cautions of ThinkLA and/or the facility where the Event is taking place at all times during the Event; and
- If at any time you begin experiencing symptoms of COVID-19, you will immediately discontinue further participation in the Event.
You also confirm you are aware of and understand the highly contagious nature of COVID-19 and the risk that you may be exposed to or contract it at the Event, which may result in serious illness, recurring and/or ongoing illness, disability and/or death.
You acknowledge that these risks may result from or be compounded by the actions, omissions, or ordinary negligence of ThinkLA or other attendees. You understand that despite reasonable measures taken by ThinkLA, ThinkLA cannot guarantee that you
will not become infected at the Event.
YOU ACKNOWLEDGE THAT YOU ARE VOLUNTARILY PARTICIPATING IN THE EVENT WITH KNOWLEDGE OF THE DANGERS INVOLVED. YOU HEREBY AGREE TO ACCEPT AND ASSUME THE RISKS STATED ABOVE, EVEN IF CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF THINKLA.
You hereby expressly waive and release any and all claims, now known or hereafter known, against ThinkLA, and its officers, directors, manager(s), employees, agents, attorneys, affiliates, shareholders/members, successors, and assigns (collectively,
“Releasees”), on account of serious illness, recurring and/or ongoing illness, disability and/or death, arising out of or attributable to your participation in the Event, whether arising out of the ordinary negligence of ThinkLA or any Releasees or
otherwise. You covenant not to make or bring any such claim against ThinkLA or any other Releasee, and forever release and discharge ThinkLA and all other Releasees from liability under such claims. This waiver and release do not extend to claims
for any liabilities that the laws of California do not permit to be released by agreement. You agree to the admission of electronic evidence of your having accepted this Release in any dispute related to it.
All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of California. Any claim or cause of action arising under this Release may be brought only in the federal
and state courts located in Los Angeles, CA and you hereby consent to the exclusive jurisdiction of such courts.
2. Monkeypox Statement
As we continue to manage the safety of our attendees at our events, we are aware of the federal and state public health emergency pertaining to Monkeypox. It’s important that we remind those who register to not attend if they have the following symptoms:
- Rashes like pimples or blisters which may be painful or itchy, including scabs
- Fever
- Chills
- Swollen lymph nodes
- Exhaustion
- Muscle aches and backache
- Respiratory symptoms (e.g. sore throat, nasal congestion, or cough)
- Flu-like symptoms
We also ask that those who are healthy enough to attend to keep the follow prevention steps in mind while at the event.
- Wash your hands often;
- Limit physical contact with other attendess and staff;
- Keep a safe distance from others to acoid prolonged face-to-face contact.
Following these important steps will help us to keep our attendees safe at our events at this time. As more information becomes available, we will continue to adapt and update our policies to align with any federal, state, local, and CDC guidelines.
